Controversial issues regarding the terms of admissibility of the rejudging request regulated by article 522 Criminal Procedure Code

Summary/Abstract: By the law no. 281/2003, the provisions of the Criminal Procedure Code have been completed by introducing the section named “Rejudging in case of extradition", containing a single article named 552 according to which: “(1) In case it is requested to rejudge a person judged and convicted in absence, the cause would be rejudged by the court of law that has judged in first court, according to the convicted person's request. (2) The provisions of articles 405-408 apply only correspondingly.” The conciseness of these provisions has caused the emergence of some law issues which in the legal practice of the courts have received different solutions
