Relations between the Church and the State in the European Union

Summary/Abstract: This paper aims at reviewing the juridical norms regulating relations between the church and the state in the European Union. The term “ecclesiastical law” is used to denote the part of state law governing legal status of churches and religious communities, and is defined as a sphere of state law that encompasses in one system the norms regulating religion as a social phenomenon. Systems of ecclesiastical laws vary in the EU due to their members’ different historical background, emotional factors and beliefs. In Lithuania, however this sphere of civil law is just undergoing the process of formation. Straipsnio tikslas – apžvelgti Europos Sąjungos valstybių teisines normas, reguliuojančias Bažnyčių ir valstybės santykius. Ši valstybės teisės dalis, reguliuojanti Bažnyčių ir kitų religinių bendruomenių juridinius santykius, yra vadinama „bažnytine teise“. Bažnytinės teisės sistemos ES šalyse skiriasi, nes jos formavimuisi įtakos turėjo istorinė patirtis, emociniai faktoriai, įsitikinimai. Lietuvoje ši pasaulietinės teisės sritis tik formuojasi.
