The parental obligation to find an agreement concerning the custody of a minor child as a part of the parental responsibility

Summary/Abstract: The paper deals with the question whether the parents are obliged, within their parental responsibility, to find an agreement in the case of their conflict. It analyses the grounds and the progression of the parental conflict and its impact on the child. It names the duties to the child that result from the parental responsibility and that the parents break by their behaviour during the conflict. The paper provides advantages and benefits of the agreement between the parents for the child and also for the parents themselves. At the end, the Cochem’s practice, as the proven proceeding for solving of parental conflicts on the conciliatory way, is presented.
