Summary/Abstract: The present contribution deals with issue of competence exception. At the beginning, is created a theoretical background and grasp the concept of competency exceptions. The aim is to answer the question whether it is possible to part V. o.s.ř. The decision of the administrative body in private matters, perceived as a competence lockout in administrative justice or not. To this end, the institute analyzed competency lockouts and defining the agenda of administrative justice in our country.
