Summary/Abstract: Based on the analysis of the legal regulations concerning building works, in relation to the quality thereof, the legislature preferred to establish a series of obligations for the beneficiary, even though they may have been regulated as rights of the latter. This method emphasizes once again the importance granted to building works. We have to mention the fact that, this way, the beneficiary becomes the factor determining the quality of building works, more than any other entity taking part in the execution of building works. Pursuant to the law, the beneficiary has all the necessary means to execute the building and to provide the quality thereof, thus being the one in charge with the quality of the works.
