Summary/Abstract: Certainly, from all the crimes within the jurisdiction of the International Criminal Court, war crimes are the oldest, combatants being prosecuted for disobeying the rules of armed conflict since time immemorial. Within the framework of the Rome Diplomatic Conference to enact the Statute of the International Criminal Court, war crimes were defined as detailed as possible. But, does this necessary mean that all aspects are cristal clear, with no room for missinterpretations or, on the contrary, may it be considered more difficult for a combatant to be prosecuted for war crimes? Answering this question is the aim of this aricle.
