Summary/Abstract: Organizing medical malpractice is still an underappreciated element of risk assessment in the management of health units in Poland, while in Western European countries, data on this phenomenon are practically used to eliminate the negative effects of medical entities. The assessment of the proper functioning of the system for medical services consists of evaluation of individual factors, such as increased patient awareness, health communication, medical ergonomics, or the test procedures of quality of provided services. The purpose of this article is to highlight the importance of the selected elements, which are important for the formation of a model system of medical services − free from the organizational phenomenon of medical malpractice. Conclusions from the analysis of the legal consequences of the phenomenon of medical errors allow for the statement that the organization of the health service has fundamental importance for the optimal performance of the tasks of all participants involved in the provision of medical services.
