Summary/Abstract: This article focuses on a current issue of interest: the accession of the European Union to the European Convention of Human Rights. The approach thereof includes, firstly, a close examination of the current legal setting of the European Union regarding fundamental rights and the relation between the European Union Law and the right outlined by the European Convention of Human Rights. The article will also show the response of the Court of Justice of the European Union, materialized in the Opinion concerning the Accession draft Agreement of the European Union to the European Convention of Human Rights.
