Considerations on childcare – object of parental’s authority attributes

Summary/Abstract: The „governance" of minor person regroups actual characteristics of parental authority. These characteristics form a beam whose synthesis is done in art. 487 Civil Code. (Fundamental text, by the way). It says: "Parents have the right and duty to raise the child, caring for his health or physical, mental, intellectual, education, teaching and training of its convictions, characteristics and needs of the child; they are obliged to give the child guidance and advice from the proper exercise of the rights, which the law recognizes it. " So, rights and duties are left suspended: not only general purpose (best interests of the child) who prints them common characteristics; always have each own object. Although,in family life, these features overlap with no clear-cut distinction is useful to discern the meaning of each, even if I do it just to prove, in all its richness, the content of parental authority. In this study we aimed to analyze only one of the attributes of parental authority on the person of the child, namely child care which contais, in our opinion the right and duty to support the child and the right and duty to maintain the child, caring for his physical, mental and intellectual health.
