Summary/Abstract: The present article intends to briefly analyze the main benchmarks which might be considered with a view to establish the relevant public in the pharmaceutical sector, with reference to distinction between over the counter medicine and medicine released based on a medical prescription, as well as the main guiding lines of the jurisprudence in this field, in the context of establishing the risk of confusion which would lead to a sign not being able to be registered as a trademark or being annulled in case it was registered in breach of prior rights.
