Summary/Abstract: Pursuant to Article 154 of the Law on proceedings before administrative courts, in the event that the judgment granting the complaint against failure to act or excessive lengthy proceedings, or in the event of failure to act by an authority or excessive lengthy proceedings after the judgment setting aside or declaring invalidity of an act or action, a party may, upon prior written call to a competent authority for compliance with the judgment or for settlement of the case, bring a complaint in this respect and request that the fine be imposed on that authority. The party to such proceedings has an additional statutory instrument of counteracting the state of failing to act or excessive lengthy proceedings by the administrative body. Hence, adopting the described solution in the Law on proceedings before administrative courts proves fully adequate. The legislator should however, in author’s opinion, consider implementing personal financial liability of employees of the administrative body for their inactivity or excessive lengthy proceedings.
