The Foundations (Waqfs) Founded in the Turkish Republic Between 1926-1967

Summary/Abstract: The concept ‘waqf’ (foundation) which is terminologically used in the Islamic law means to allocate the future income of a property which is under private possession to the public benefit with charity purposes. The waqf institution which historically dates back over a thousand years surrounded social, cultural and economic life extensively particularly in the Ottoman period. Hence, the existing literature related to the waqf institution is largely connected with the waqfs of the Ottoman period. What kind of activities the waqf institution which has undertaken every kind of social services of the Ottoman State for ages, has carried out in the Turkish Republic which is the heir of the Ottoman State and its place and prominence in social, economic and cultural life is a topic which is worth studying. Moreover, it is thought that the developments on the waqfs and the projects in recent years have made such studies ne-cessary. In this study, the waqfs which were set up with the name of “foundation” between 1926-1967 in the Republic period are handled. The process about the situation of the waqfs in the Turkish Republic started in 1924 when pious foundation was abolished and continued with the Turkish Civil Law which became effective on the 24th of October, 1926. The nine items of this law from Item 73 to Item 81 are related to the foundations. In these items the word “foundation” instead of the term “waqf” has been used. In this law the situation of the waqfs before the announcement of the Republic has not been tackled but only the items which applied to the waqfs which would be newly established have been presented. Thus, the waqfs have been called as “foundation” which were established in the time period from the production of the new Waqfs Law numbered 903 and issued in 1967 till the insertion of the term “Wagf” instead of the term “Foundation” in this law.
