Principles of Public Administration and Government in European Union

Summary/Abstract: Although Roman Contracts and other EU legal sources do not provide for specific model of public administration the member states have to establish, question of common administrative law is discussed since the beginning of European Union. In time, democratic states accomplished general consensus about the key elements of good governance. These elements share member states with different legal traditions and different systems of public administration, and it is about: 1. accountability 2. reliance and predictability (legal security) 3. openness and transparency 4. participation. Although a notion of European Administrative Space was coined, it is still hard to talk about European way or model of public administration and public government, since that is in the first place a sphere of nation-states and as such it is also conceptualized. European administrative space represents evolution of the growth of convergence between governmental-legal orders and governmental practice of the European Union member states. It deals with basic institutional regimes, processes, common governmental standards, values of state and public governance, and administrative culture. Principles of public government and governance shared by the EU member states emanate from standards found behind governmental law in the majority of the member states and behind the decisions of the European Court of Justice. Fulfillment of these principles also requires respect of standards which should lead, for example, candidate states such as Croatia, during the harmonization of its public government and governance with European Union.
