Summary/Abstract: The author of the paper deals with the issue of criminal legal reaction to recidivists. The high rate of recidivism indicates that there are imperfect solutions in penal legislation with respect to the reaction against recidivists. In this regard, the author gives an overview of some characteristic penal systems of their reaction to recidivists. The author concludes that the severe penalties for recidivists not only violates the basic rule for double punishment for a crime, but also embraces the principle that people should be punished because of their personality. Recently, more efforts are seen to abandon the notion that recidivism may be disrupting the severe and lasting penalties or elimination of the offender.
