Summary/Abstract: Władysław Bartoszewski rightly referred to the decision of the European Court of Human Rights (ECtHR) of 7 October 2008 as “one of the most significant international documents having an impact on Polish-German relations.” In this decision the Court rejected the application of the Prussian Claims Society (Preussische Treuhand GmbH & Co Kg A. A.) concerning compensation for property belonging to the Germans expelled from territories received by Poland (by virtue of the Potsdam Agreement of 2 August 1945) which had previously constituted a part of the eastern territory of Germany. This assessment on Professor Bartoszewski’s part is based on three substantial factors.
