Summary/Abstract: The amparo proceedings, a Latin‐American legal institution, it occurs in the comparative law as a complex juridical instrument protecting fundamental rights and freedoms, turned against violations or attempt of violation of these rights. The present study represents just a first part of a comprehensive comparative legal analysis on the amparo proceedings and proposes a three‐dimensional objective. First, we consider the presentation of historical and political context of how the confluence of European law with the U.S. led to a genuine legal institution in the field of fundamental rights protection in Mexico. Then it must be determined by the legal nature of the institution according to the specifics of different national laws (constitutional right or legal guarantee for the protection of fundamental rights and freedoms). Finally, we’ll emphasize the practice of amparo proceedings on the European and American continents, the legal institution occurring in the comparative law in various equivalent ways, as Amparo (Guatemala), Accíon de amparo (Argentina, Ecuador, Honduras, Paraguay, Uruguay, and Venezuela), Accíon de tutela (Columbia), Juicio de amparo (Mexico), Proceso de amparo (El Salvador, Peru), Recurso de amparo (Spain, Bolivia, Costa Rica, Dominican Republic , Nicaragua, Panama), Recurso de proteccíon (Chile), Mandado de segurança and mandado de injunçao (Brazil) or Verfassungsbeschwerde (Austria and Germany). The second part of this comparative legal analysis will be published in the future number of Romanian Journal of Comparative Law and will focus on tracing the substantial legal coordinates of these important institution protecting fundamental rights and freedoms: the proceedings actors, the dimension of the rights and persons protected by it, the nature of harmful deeds or likely to violate a right, the proceedings principles and the legal effects of the procedure.
