Summary/Abstract: This paper deals with the constitutional judiciary. It starts with theories of branches of powers in state and the role of constitutional courts. The positions of constitutional courts in European countries are discussed as well as the legitimacy of critical approaches towards their work. The criticism is presented as way to control their powers. Constitutional courts should be treated as guarantee against the misuse of political power.
