Summary/Abstract: Even though much effort has been undertaken in studying the institutional dynamics, most analysis is on representation, structuring and separation of democratic institutions. Often it is argued that analyzing institutions has to challenge their lack of efficiency but usually, this kind of analysis simplifies the framework as it stops where the institutions dramatically affect the participant actors’ interests. This paper explores the prerequisites of effective institutions while keeping their legitimacy by representing the interests of citizens. First, I will argue that the legitimacy of constitutional contract - as the primary institutional level where the interests are organized - affects the institutional performance of the subsequent institutional levels. Then, I will highlight that ability of focusing on the institutional dynamics and efficiency from the constitutional moment point of view is a compulsive investigation method to analyze the democratization in Romania.
