Perfume and copyright protection

Summary/Abstract: The perfume is a product with a pleasant smell, which is created through the mixture of different substances. In this article, we want to establish if the scent of a perfume can be protected as an object of copyright within the framework of Romanian copyright legislation. The Courts from France and Netherlands decided that the scent is protectable by copyright. On the other hand, the fragrance is a result of a know-how application which means it is not an act of intellectual creation. This opinion can be found in two decisions given by the French Courts in 2006 and 2008.
