Summary/Abstract: The main purpose of this doctrinal contribution was to analyze the special faculties, recently promulgated, and granted by the Supreme Pontiff Benedict XVI to three Congregations of the Roman Curia responsible for Doctrine of the Faith, Evangelization of Peoples, and the Clergy, to streamline in poenam procedures with relation to those faithful, especially clerics, who committed grave crimes against the faith and customs. This critical analysis of both new details and proposed legal procedures aims to demonstrate the provisional nature of particular Faculties and intends to propose possible solutions under criminal law in the light of the intended overhaul of Book VI. The solutions adopted by the Congregations, especially regarding transfers of secular clerics into the secular state, raise justified doubts as to the consistency of the canonical norms, pointing to the necessity to promulgate ius novissimum, which would regulate this aspect of ecclesiastical life. The obtained results suggest that the reform should guarantee an alleged perpetrator a right to defence, calling for more effective functioning of competent ecclesiastical organs by bringing particular procedural means up to date.
