REGULATION OF THE STALKING-OFFENCE IN COMPARATIVE LEGAL APPROACH

Summary/Abstract: The issue of stalking is a question of demanding regulations in the field of criminal law for many years. This is demonstrated by dramatic events involving victims of stalkers. Article 190a, which regulates the stalking-offence in Polish Criminal Law, was introduced to the Penal Code by amending Act of the 25th of February 2011 This paper presents a comparative legal aspects of the crime, based on patterns developed in this regard in other countries. Including but not limited to the United States, Germany, Britain, Italy and France, showing both the difficulty of regulating this type of offence, and possible legislation solutions in this area.
