Lobbying activity in the legislation in Poland – considerations based on the theory, law and practice

Summary/Abstract: This article is to show legal basic forms and the range of the lobbyist activity in the Polish legislation. It focuses on the Polish Constitution of 1997, the Act on Lobbying Activity in the Law-Making Process (adopted on July 7th 2005) and the Polish parliamentary regulations. The terms and methods of the lobbying activity in Poland are shaped, in particular, by the Act on Lobbying Activity in the Law-Making Process. The Act contains legal definitions of the lobbying activity and the professional lobbying activity, principles of transparency, rules of the professional lobbying activity and forms of lobbing control. The most important method of the lobbing activity in legislation is the public hearing. The Polish lobbying regulations show the lack of the clear and coherent model and rules of lobbying activity in legislation. This is the main reason to apply more substantial and acceptable model of lobbying that would be consistent with other regulations existing in the Polish legal system.
