EU Law Flexibility – A European and Czech Law Perspective

Summary/Abstract: European law flexibility makes it possible to change the rules of conduct set out in an act of greater legal force by means of an act of lower legal force. Among various cases of such legal flexibility, Article 48(6) TEU attracts special attention because it concerns changes of the EU founding treaties in the form of a Council decision – an EU secondary law act. This case of flexibility provokes consequences not only within the EU legal system, but in national law as well, as demonstrated in this article using the case of Czech law.
