Summary/Abstract: The article deals with the scope of state liability for damages as a result of unlawful actions of investigative bodies in the pre-trial proceedings of the criminal process. The practice of the Supreme Court on the application of Art. 2, para. 1, item 3 of the Law on the Liability of the State and Municipalities is studied. Based on the analysis, the conclusion is justified that the State is liable even when the injured person was not involved as an accused in the pre-trial proceedings.
