Summary/Abstract: This article analyses the policy of patient access to electronic health data in Poland from the perspective of the concept of the policy implementation gap, with particular emphasis on the relationship between obligations arising from European Union law and national regulatory and strategic autonomy. The analysis demonstrates that Poland has achieved a high level of infrastructural maturity in its digital health system (92% in Digital Decade 2025); however, deficiencies are identified with regard to the availability of certain categories of data (67% in the 'access to health data' layer). The conclusions formulate recommendations concerning the reorientation of digital health development policy towards strengthening patients' digital and health competences.
