Summary/Abstract: The main goal of a democratic state is to protect the fundamental rights and freedoms. The real challenges for the national security system trigger the need of legislative flexibility that should allow the national authorities to operate and achieve their goals without restricting the fundamental rights and freedoms, but providing the opportunity only to restrict the exercise of these rights and freedoms.
