Summary/Abstract: The right to notice occurs when we talk about the unilateral cessation of the labor contract, but it is also a right enjoyed both by the employee and the employer. In fact, the right to notice in case of resignation must be obeyed by the employee, but in case of dismissal, it must be obeyed by the employer. The two situations are not juridical similar regarding the legal reglementation, even if the meaning of the notice right is the same. The main distinction is made by the interdiction for the employee to give up all rights, which the law stipulates on his behalf.
