Summary/Abstract: In the classical concept of commercial law, the enterprise was defined as an economic body, headed by a person named entrepreneur, who combines the forces of nature with capital and labor for the purpose of producing goods and services. In the modern doctrine of commercial law, the enterprise was defined as a human group, coordinated by the organizer, in order to carry out a commercial activity. In another sense, the enterprise appears as an economic and social body, an autonomous organization of an activity, using the factors of production (forces of nature, capital and labor) by the entrepreneur, at his own risk, for the purpose of producing goods, execution of works and the provision of services for profit. In the design of the Civil Code, the systematic exercise by one or more persons of an organized activity consisting in the production, management or disposal of goods or in the provision of services is classified as an enterprise whether or not it has a lucrative purpose. If the activity is lucrative, then the enterprise is economic (commercial), and if the activity has not a lucrative purpose, if it does not seek profit, then the activity in question is a civil enterprise.
