Summary/Abstract: Four recent judgments of the Court of Justice of the European Union (CJEU) are reshaping the way the interaction between transfer pricing, VAT, and customs should be viewed. The Court’s message is clear: for intra-group transactions, including transfer pricing adjustments, the VAT treatment cannot be determined automatically just from how a payment is formally classified. Instead, it must be determined following a thorough analysis of the nature of the transaction and the economic relationships between the companies involved. Below, we will summarize the main conclusions drawn from the CJEU rulings and highlight their practical implications for how groups must structure and document their intra-group transactions, simultaneously through the lenses of VAT, transfer pricing, and customs.
