Summary/Abstract: Digitalization has transformed the economy and contractual relationships, leading to new methods of expressing consent and performing contractual obligations in the electronic environment. From click-wrap agreements to AI-assisted transactions and automated mechanisms for the performance of obligations, these developments require an in-depth legal analysis. The article examines the legal implications of the transformation of digital contracts within the European market, focusing on the relationship between party autonomy, algorithmic transparency, and legal certainty. The study analyzes how the classical principles of contract law are adapted to new technologies through the examination of electronic consent, the role of click-wrap agreements in digital commercial practice, and the use of artificial intelligence in the negotiation, formation, and performance of contracts.
