Summary/Abstract: The following are examined: the subject of the set-off objection, when the defendant’s claim is greater than the claimant’s claim; the objective limits of res judicata of the court decision with respect to the amount of the defendant’s claim, when the objection is upheld; as well as when it is rejected due to the non-existence of the receivable, due to the non-enforceability or non-compensability of the defendant’s claim.
