IUSTITIA ET BONA FIDES, PROPUGNACULUM ADVERSUS ABUSUM IURIS

Summary/Abstract: In Roman law, there was no general principle prohibiting the abuse of rights; however, Roman jurists laid its foundations with the idea that a right may not be exercised for a harmful purpose. Protection was afforded through specific actions and defenses grounded in good faith and justice. This article traces the development of this principle and its manifestations in the case law of the Constitutional Court of the Republic of Bulgaria.
