Summary/Abstract: The following paper traces the development of the views expressed in the Bulgarian legal doctrine on the contractual prohibition of assignment (pactum de non cedendo) under the provision of Art. 99, para. 1 of the Law of Obligations and Contracts, which represents the first ever legislative embodiment of the clause within our legal system. The study reveals three main opinions on the legal effects of this arrangement, which differ regarding the issues whether the claim is transferred at all and whether the debtor can lawfully refuse performance to the assignee. These doctrinal hesitations have also produced an impact upon relevant Bulgarian case law. Thus, there is no prevailing understanding of the legal consequences arising under this clause in our legal system. Finally, the study makes a proposal de lege ferenda for specifying the provision of Art. 99, para. 1 of the Contract Law, so that it unambiguously clarifies the scope and legal consequences of this agreement.
