Summary/Abstract: The concept related to the separation/balance of powers, although a sine qua non condition, is not yet fully met in the Romanian society. In order to understand this statement it is necessary to go back to ancient philosophies in an attempt to expand the concept of power in relation with theoretical explanations and complement it by offering empirical information. Transition and post-transition in Romania provided the microlaboratory that enabled us to observe how constitutionalism has been reinterpreted. Nevertheless, in order to strengthen the democratic system it is essential to make the necessary constitutional changes whether it is the tension between the President and the Prime-Minister, the debates regarding the bicameral Parliament or the overlap between the functions of the two Chambers of the Parliament.
