12. Absolute nullity of administrative acts concluded in breach of the legal provisions on conflict of interest

Summary/Abstract: Interpreting Article 46 of Law No. 215/2001 in conjunction with Article 22 of Law No. 176/2010, any resolution adopted by the local council is void by operation of law where the collegiate body ought to have known and could have known of the conflict of interest in which the local councillor who took part in the deliberations and in the adoption of that resolution found himself, in which respect any means of evidence may be adduced, as well as where the local councillor, through his presence and/or vote, ensured the quorum or the majority required for the adoption by the local council of the disputed resolution.
