Consideraţii privind substituţiile fideicomisare în noul Cod civil
Considerations regarding the the fideicommissary substitution in the new civil Code

Summary/Abstract: Although in the matter of legal documents regarding the decease the principle of freedom of any person to dispose of the property according to his own will is enshrined, there are some categories of legal documents which were prohibited by the Civil Code of 1864, either in whole or in part, for reasons of moral or family interests, or for compliance with the principles of freedom of disposition and the free movement of goods. In the category of prohibited documents the pacts on future inheritance, the documents affecting the reserve of inheritance and fideicommissary substitution are also listed. In this study we analyze the latter legal documents which, by the new Civil Code have gained largely, another legal configuration.
