Considerations regarding the current matrimonial regime

Summary/Abstract: It is, of course, evident that the regulation of the spouses’ patrimonial relations in the 1954 Family Code was influenced by the collectivist ideology characteristic of that era. Article 30, paragraph 1 of the Code established the regime of community property, presuming that any asset acquired by both spouses or by only one of them is jointly owned. Any contrary agreement, according to paragraph 2 of the same article, is null and void, and finally, paragraph 3 stipulates that the inclusion of an asset in the jointly owned community does not require proof.
