Summary/Abstract: The article focus on the analysis of the presidential influence on the use of American forces. The author presents his arguments throughout critiques the presidents activity on the military affairs. The trend of presidential war powers after the Word War II collides with the constitutional framework adopted by the Founding Fathers. Congress passed the “War Powers Resolution” in 1973 to limit the scope of presidential influence, however its efforts failed. The document focus on the rules that limited presidential influence on the American forces but in practice it became the background for the presidents activity. Many authors insist that illegality should not be legitimacy by practice however presidential acts of war became reality. In practice presidents today can use American forces without congressional approval. The situation is informally accepted by Congress and public opinion.
