The evolution of law in Albania: from customary law to the modern legal system and human rights standards

Summary/Abstract: The evolution of law in Albania constitutes a complex historical and legal process, reflecting the interaction between traditional norms and modern legal systems. This article examines the transition from Albanian customary law to an institutionalized legal system grounded in the principles of the rule of law and human rights. Using a historical, comparative, and analytical methodology, the study explores the role of the Kanun of Lekë Dukagjini, the process of legal codification, the influence of the Ottoman and communist periods, as well as post-1990 transformations. It also addresses the impact of international instruments, particularly the European Convention on Human Rights and the jurisprudence of the European Court of Human Rights. The findings indicate that, despite legal modernization and European integration, elements of customary law continue to influence both social and legal practices in Albania. The article highlights the need to harmonize legal tradition with international human rights standards, suggesting institutional reforms and legal education as key tools for strengthening the rule of law.
