Summary/Abstract: This study outlines the theoretical aspects of the establishment of the European Commission for Democracy Through Law (the Venice Commission), a consultative body of the Council of Europe. The Commission was created in 1990, following the fall of the Berlin Wall, in response to the urgent need for constitutional assistance in the newly emerging democracies of Central and Eastern Europe. Its mission is to provide legal expertise to the member states of the Council of Europe, as well as to other states.
