Summary/Abstract: This article examines the principles governing plea agreements in criminal proceedings in the Republic of Moldova, highlighting their importance in enhancing the efficiency of the administration of justice and the protection of the fundamental rights of the parties involved. Fundamental principles such as legality, fairness towards the accused, availability, the right to defence, expediency, the efficiency of criminal prosecution and others are analysed, highlighting how they influence the conduct of criminal proceedings and contribute to maintaining a balance between the interests of the state and those of the accused. The study emphasises strict adherence to these principles to ensure the legitimacy and efficiency of the judicial process. The analysis of ECHR case law reveals that the validity of the agreement depends directly on respect for the defendant’s rights and procedural safeguards. It is concluded that the effectiveness of the cooperation with legal requirements and the fundamental principles of criminal proceedings.
