Summary/Abstract: The cooperation agreement procedure is regulated as a special procedure, provided for in Title III, Chapter III, Section 2 of the Criminal Procedure Code of the Republic of Moldova. This new procedure, applicable exclusively to individuals with the status of defendants in a criminal case, provides for a number of strict conditions for its application. These include: the existence of certain categories of offences, specific obligations for the accused, the involvement of specialised prosecutors, the need for approval of the agreement by the Prosecutor General, and the mandatory participation of a defence lawyer. The court also plays an essential role in validating or rejecting the agreement. This study aims to analyse this procedure, highlighting its role in the criminal justice system and its implications for contemporary criminal policy.
