Summary/Abstract: In the author's opinion, the obligation to submit financial disclosure statements by individuals applying for free legal assistance should remain in the statute, and a mechanism for verifying their authenticity should be established. Funding free legal assistance and civic counselling by the state may be considered state aid under the Treaty on the Functioning of the European Union (TFEU) and, therefore, may be subject to EU competition law. The author of the opinion expresses doubts as to whether the current situation in the legal services market really justifies the introduction of a system of free legal assistance and free civic counselling available to all, regardless of the financial situation of the beneficiaries.
