THE PETITION FOR THE INITIATION OF AN INSOLVENCY PROCEEDING UNDER THE PERSONAL INSOLVENCY ACT

Summary/Abstract: Following the promulgation of the Personal Insolvency Act in the State Gazette on July 4, 2025, provision were introduced for the possibility of conducting insolvency proceedings against individual consumers who have become insolvent. This article aims to examine the issues of jurisdiction - first instance court competence and a local jurisdiction, when considering to file a petition for the initiation of an insolvency proceeding under the Personal Insolvency Act, as well as its content and applications, and the procedural rules for its consideration, in an attempt to facilitate the application of the new Law by practicing lawyers. The Personal Insolvency Act is critically analyzed and proposals are made for its interpretation and application.
