Summary/Abstract: This study is motivated by the growing global threats to academic freedom, even in democratic societies. Academic freedom is a key indicator of democratic health and scientific development amid political transformations and constraints on university autonomy. Despite an extensive international legal framework, the effective implementation of academic freedom guarantees remains a challenge, underscoring the need for comprehensive analysis at both the international and national levels. This article examines contemporary scientific approaches to defining academic freedom, exploring its legal nature and role within the international human rights system. It analyzes relevant international legal instruments and their application in national contexts. It identifies key gaps, including the lack of a specialized treaty, unclear implementation mechanisms, and dependence on state political will. Practical recommendations are proposed to strengthen legal regulation and institutional safeguards for academic communities.
