Summary/Abstract: The Separation of Powers in the State – A Guarantee of Fundamental Rights. The present study analyzes the principle of separation of powers as the constitutional foundation of the rule of law and the main institutional guarantee of fundamental rights and freedoms. Starting from the classical theories of Locke and Montesquieu and extending to the modern constitutional practices of the United States, Germany, France, and Romania, the article argues that freedom and legality are inseparable from the limitation and balance of public power.The first part of the study explores the historical and philosophical origins of human rights and their constitutional consecration. The second part examines the current functioning of the three branches of power in contemporary democracies, highlighting their mechanisms of cooperation and mutual control. The third part demonstrates that the independence of the judiciary, the control of constitutionality, and the role of civil society act as essential guarantees for the protection of individual rights. The fourth part investigates current challenges – populism, global crises, digital transformation, and the rise of artificial intelligence – which test the resilience of constitutional democracy and the effectiveness of institutional checks and balances. The comparative analysis shows that the separation of powers is not merely a formal organization of authority, but a normative and ethical order that ensures the supremacy of law over arbitrary rule. In the context of globalization and digitalization, the principle evolves into a broader concept of global constitutionalism, where national and supranational institutions cooperate to protect human dignity. Therefore, the separation of powers must be understood today as both a legal structure and a moral culture of restraint – the living expression of freedom within the constitutional state.
