Summary/Abstract: The article discusses legal provisions in the German penitentiary system that allow incarcerated mothers to provide care for their children while in custody. Special attention is given to § 76 of the Federal Act on the Execution of the Penalty of Deprivation of Liberty and Measures of Correction and Prevention (StVollzugsgesetz, StVollzG), which ensures pregnant inmates access to medical and obstetric-gynecological care, as well as § 80, which regulates the placement of children with their mothers in specially designated facilities (Mutter-Kind-Einrichtungen). The conditions of admission to the facility, access to support programmes and healthcare, as well as the potential benefits and risks of this solution, were analysed, with consideration given to the number of available places nationwide. To provide a broader comparative perspective, the provisions of the Polish executive penal law have also been examined.
