Summary/Abstract: In a society where the individual's access to culture is allowed by Art. 33 of the Romanian Constitution, but also Art. 12 of Law no. 8 / 1996, which speaks of “copyright”, through which the author of a work decides whether his creation can be accessed by the public or not. I will try to show through this essay how equal opportunities can be ensured, the recognition of the artistic merits of authors, without being conditioned by economic and social criteria, which from an ethical point of view can create inequalities in society; but also the unrestricted right of any individual to culture.
