Summary/Abstract: Under both Article 20 of the Polish Constitution and Article 3(3) of the Treaty on European Union, the same principle governs general economic organisation - a social market economy. In the following article, the social market economy is treated as the binding economic constitution in both legal systems. Through this prism, a comparative analysis is made of the axiology of the judgment of the Polish Supreme Court in case III SK 5/17 and of the Court of Justice of the European Union in case C-413/14. This article seeks to answer the question of whether there are similarities in the reception of the social market economy of ordoliberal thought in both legal systems.
