Summary/Abstract: In the paper, the authors deal with the problem of illegal migration and the protection of the state against the “infestation” of migrants. The beginning of the modern migrant crisis, as a care￾fully planned action related to the migration of people, is linked to the year 2010 and the countries of North Africa and the Middle East. The countries of the European Union are becoming the desired destination of migrants. The goal of such a plan is to create a completely new limited sovereignty and order, and destroy the previous one. The result of the de-sovereignation of national states is also the European Union, which in the last fifteen years has been preserving the national identity of its member states in the fight against illegal migration. The increasing progression of illegal migration and the enormous increase of illegal migrants necessarily lead to the policy of tightening the conditions of the destination country for the reception of migrants and the return of those who found themselves in the territory of the “promised land” without a legal basis. In the paper, the authors pointed to the international and national legal framework for protection against illegal migration, as well as respect for the constitutional rights of citizens of immigrant countries in the age of the migrant crisis. Migrants represent a security risk and a threat to the security of the state border, which necessarily requires and demands an adequate and prompt response of the state to prevent illegal crossings of state borders and to stop people smugglers and smuggled people in their illegal plans. Migrants become a threat to the domestic population due to disruption of the economy and economic system of the state through the relationship between the supply and demand of workers. Migrants are slowly taking away jobs from the local population because they are in principle cheaper labor force, while in the absence of earnings, they can start to engage in criminal activities, which is why they become a threat to the legal order of the destination country and its population.
